Terms of Service

These Terms of Service ("Terms") govern your use of Buya3DPrint, operated by Kemal Yaşayan ("Buya3DPrint", "Platform", "we"). By accessing or using the Platform you agree to these Terms.

1. What Buya3DPrint is

Buya3DPrint combines three distinct but connected services in one platform:

• Digital 3D model marketplace — designers ("Creators") upload STL/3MF and similar files, free or paid; buyers download them.
• Physical product catalog — Buya3DPrint manufactures and sells physical prints of selected designs directly; the Creator earns a royalty on those sales.
• Print Partner manufacturing marketplace — customers request a custom manufacturing quote, approved local print partners ("Print Partners") bid, the customer selects and pays for one quote; production and shipping are handled directly by the Print Partner.

Buya3DPrint's role differs across these — see "3. Who sells what" below. This is not a single-seller storefront model; each transaction type has its own contractual shape.

2. Your account

You must be at least 18 and have legal capacity to use the Platform. You are responsible for the accuracy of your account information and its security. For the full list of data collected at signup, including via Google sign-in, see the Privacy Policy.

You may permanently delete your account at any time from Settings → Security. This anonymizes your profile and deletes most personal data; purchase, order, royalty, and payment records are retained for legal/accounting reasons — see the Privacy Policy's "Data Retention" section for the exact scope.

3. Who sells what — marketplace roles

Legal requirementDifferent jurisdictions draw this line differently (in Turkey, whether a platform is a direct seller or a marketplace intermediary under Law No. 6563 and its implementing regulation is assessed per transaction type). At Buya3DPrint the roles are:

• Digital model sale: The Creator sets the price. The Creator is the seller/licensor; Buya3DPrint collects payment and technically manages delivery (download access) as an intermediary.
• Physical catalog product: As stated on each product page, these items are manufactured and sold by Buya3DPrint. Only Buya3DPrint sets price, inventory, and variants; the Creator receives a flat 10% of the product sale price as a royalty — not reduced by shipping, tax, or production cost — not a co-seller position. Buya3DPrint is the seller in this flow.
• Print Partner manufacturing: The bidding Print Partner sets the price and handles production/shipping directly. Buya3DPrint collects payment and oversees inter-party communication and production standards as an intermediary — see the Print Partner Terms.
• Membership: A direct service relationship between Buya3DPrint and the subscriber.

Product decisionBuying a model's digital file does not grant any right to that model's physical print; buying a physical product does not grant any right to the digital design file it's based on — unless a product/model page explicitly states otherwise, these two purchases are always independent and must be bought separately.

4. Licenses and content

A Creator retains ownership of their uploaded content; see the License Terms for the exact scope of what is licensed to Buya3DPrint and to buyers. Rules for user-uploaded content (copyright, notice-and-takedown, prohibited content) are in the Intellectual Property & Takedown Policy and Community Guidelines.

5. Payment and pricing

Payments are processed through PayTR (the current default and active payment provider). iyzico and Stripe are retained in the platform's infrastructure and may be activated as an alternative/backup provider in the future, but are not active as of this Terms version. Prices, taxes, and any additional fees are shown before payment. Your payment details (including card numbers) are never stored on Buya3DPrintservers — they go directly to PayTR/iyzico/Stripe.

Product decisionDigital model sales use a fixed revenue split: 85% to the Creator, 15% to the platform. Physical catalog products pay the Creator a flat 10% of the product sale price, as stated in section 3 above. These rates apply as of this Terms version; this page is updated if they change.

Product decisionA Creator's balance is held in two states: pending (the refund-risk window hasn't expired yet — not spendable, not payable) and, once that window expires, available. Available balance can be applied immediately as a payment method for a digital or physical purchase within the marketplace (no need to wait for payout), but only when it covers the entire purchase price — there is no partial balance use; if the balance is insufficient, payment is collected normally through the selected payment provider. Once available balance reaches a $100 (or equivalent) threshold, the weekly payout run pays out the entire eligible balance — never a partial amount capped at the threshold. Turkey-based Creators are paid via IBAN; an international payout method has not yet been decided.

Legal requirementA Print Partner cannot be paid out without first uploading an approved invoice covering the relevant orders — this is enforced server-side, not merely hidden in the interface. Customers can view and download invoices issued by Buya3DPrint from their order history.

6. Refunds, withdrawal, and delivery

Digital content, physical products, and custom manufacturing requests each have different refund/withdrawal rules — see the Refund & Withdrawal Policy, Digital Content Policy, and Shipping & Delivery Policy.

7. Prohibited conduct

• Uploading content you don't own or aren't licensed to distribute,
• Uploading files containing malware,
• Impersonating another user or providing false information,
• Attempting to bypass platform fees via off-platform contact with a Print Partner or customer,
• Requesting or offering to manufacture illegal, dangerous, or third-party-rights-infringing products.

8. Moderation and account termination

Product decisionContent is reviewed reactively, via reports — there is no automated pre-publication screening. Confirmed violations can result in content removal, suspension, or termination. This is not a guarantee of flawless pre-screening — it's a commitment to act within a reasonable time after a report.

9. Limitation of liability

Legal requirementBuya3DPrint limits its liability for inter-user (Creator-buyer, customer-Print Partner) content and manufacturing quality to the fullest extent permitted by law —Buya3DPrint is not a party to that underlying content/manufacturing relationship, it intermediates between the Creator or Print Partner and the buyer. This limitation does not cover mandatory consumer-protection rights under Turkey's Law No. 6502,Buya3DPrint's own liability for intentional misconduct or gross negligence, or any other liability Turkish law does not permit to be limited — those remain in full force regardless of this section.

10. Dispute resolution

Turkish consumers may apply to the relevant Consumer Arbitration Committee (within monetary thresholds) or Consumer Court for larger disputes. EU-resident consumers may also use the European Commission's Online Dispute Resolution (ODR) platform.

11. International sales

Legal requirementDigital models are sold worldwide; the current active payment provider is PayTR (iyzico and Stripe are retained in the platform's infrastructure but not currently active). Physical products are manufactured and shipped within Turkey only today (see the Shipping & Delivery Policy). These Terms are drafted primarily against Turkish law; a consumer resident outside Turkey may still be entitled to the mandatory consumer-protection rights of their own country under applicable private international law, and this document does not override those rights.

12. Changes

These Terms may be updated; each revision is published with a new version number and effective date. Material changes are communicated with reasonable notice.
